Georgia Girl Suing Local School District for Unauthorized Use of Facebook Picture
Chelsea Chaney, a 21 year old student from the University of Georgia, is suing a local Georgia school district for $2 million after they used a picture from her facebook page without her permission.
Bikini clad and then just 17, Chelsea Chaney posted a picture on Facebook of herself posing next to a card board cut out of Snoop Dog while on a family trip in 2009. Four years later:
she had no idea that the photo would be shown to hundreds of strangers at a Fayette County Schools district seminar. An administrator used the photo to demonstrate the dangers of posting to social media using the caption, “Once its there, its there to stay”
Although the school district has repeatedly apologized for using the picture without Chaney’s permission, they are asking that the case by dismissed arguing that the picture was randomly chosen.
Pete Welborn, Chaney’s attorney, says the administration still broke the law:
Their idea that putting something on Facebook gives them a license to steal it and carte blanche to do with it what they did is wrong ethically, it’s wrong morally and it’s absolutely wrong legally
